Terms of Service

1. Introduction

Welcome to Swot Up ("the Service"), operated by Swot Up Ltd ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms of Service.

If you are under 18 years of age, you must have obtained consent from a parent or guardian before using the Service. By using the Service, a parent or guardian confirms they have read and agree to these terms on behalf of the student and accept responsibility for ensuring the student complies with them.

If you do not agree to these terms, please do not use the Service.

2. The Service

Swot Up is an educational revision aid designed to support students preparing for GCSE examinations. We provide practice questions, AI-powered tutoring, and progress tracking tools aligned to UK examination board specifications.

The Service is intended to complement, not replace, school teaching. We make no guarantee that using Swot Up will result in any particular grade or examination outcome. Results depend on many factors beyond our control, including individual effort, the quality of school teaching, and examination conditions.

3. Accounts

You must provide accurate and truthful information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Your account is personal to you and must not be shared with or transferred to any other person. If you become aware of any unauthorised access to your account, notify us immediately at hello@swotup.app.

4. Subscription and Pricing

4.1 Free Trial

New accounts receive one month of full access to the Service free of charge. No payment card is required to start your free trial. At the end of your free trial, access to premium features will be limited until you subscribe.

4.2 Subscription

Following the free trial, continued full access requires a subscription at £9.99 per month. Payment is processed securely via Stripe. You may cancel your subscription at any time via the Settings page within the app, or by emailing hello@swotup.app. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.

4.3 Credit Packs

In addition to your subscription, you may purchase Credit Packs for additional AI usage beyond your daily free allowance. One credit equals one AI Tutor message or one AI-marked answer. Credits do not expire and are only consumed after your daily free allowance has been exhausted.

5. Fair Usage Policy

To ensure a quality experience for all users, the following daily usage limits apply:

Daily allowances reset at midnight UK time. Additional usage is available via Credit Packs (see section 4.3). We will give at least 30 days' notice of any material changes to daily limits.

6. Acceptable Use

You agree not to:

• Share your account credentials with any other person.
• Copy, reproduce, or redistribute any content from the Service without our written permission.
• Use automated tools, bots, or scripts to access or interact with the Service.
• Attempt to reverse engineer, decompile, or otherwise obtain the source code of the Service.
• Circumvent or attempt to circumvent any usage limits or access controls.
• Use the Service for any unlawful purpose or in a way that could harm Swot Up Ltd or other users.

7. Intellectual Property

All content within the Service — including but not limited to questions, explanations, mark schemes, AI-generated responses, design, branding, and software — is owned by or licensed to Swot Up Ltd.

"Swot Up" is a registered trademark of Swot Up Ltd. You may not reproduce, distribute, publish, or use any content from the Service for any commercial purpose without our prior written consent. This prohibition includes sharing screenshots or recordings of content for redistribution, whether for commercial gain or otherwise.

8. AI-Generated Content

Swot Up uses artificial intelligence provided by Anthropic (Claude) to power our tutoring features. Whilst we take reasonable care to ensure the accuracy of AI-generated content, AI models can and do make errors. You should verify any information provided by the AI Tutor with your teacher or authoritative study materials before relying on it in examination preparation.

Anonymised conversation data may be analysed by Swot Up Ltd for the purposes of improving the quality, accuracy, and safety of the Service.

9. Teaching Method Alignment

We aim to align our content and coaching approaches with the teaching methods used in UK secondary schools. Our AI coaching is informed by ongoing input from students and teachers.

However, individual schools may teach topics in different sequences or using different methods. If you find that our approach differs significantly from your school's teaching, please let us know via the in-app feedback tool so we can continue to improve.

10. Data Protection and Privacy

We are committed to protecting your privacy and that of any child using the Service. We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and the ICO's Age Appropriate Design Code (Children's Code).

11. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. To the fullest extent permitted by applicable law, our total liability to you in respect of any losses arising under or in connection with these terms shall not exceed the total subscription fees paid by you in the 12 months immediately preceding the event giving rise to the claim.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other matter that cannot be limited or excluded by law.

12. Termination

You may cancel your subscription and close your account at any time via the Settings page in the app, or by emailing hello@swotup.app.

We reserve the right to suspend or terminate your access to the Service at any time if you breach these terms, without liability to you. Upon termination, your right to access the Service ceases immediately.

13. Changes to Terms

We may update these terms from time to time to reflect changes in our Service, technology, or legal requirements. We will notify you of any material changes by email to the address associated with your account. Your continued use of the Service after the notification date constitutes your acceptance of the updated terms.

14. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
